The Website allows users to create AI avatars by uploading pictures of themselves and generating photos based on a text prompt. Please note that the results generated by the model may not always be accurate or appropriate. AvatarStudio.art does not assume any responsibility for the results generated by the model, and it is up to the user to use their discretion when using the Website.

User Conduct

By accessing the Website, you agree to use it only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Website by any third party. You also confirm that you will only upload images of YOURSELF to the Website and that you have the copyright rights to any photos you upload.

Nudity and Distorted Images

The model may generate photos that contain nudity or distorted or deformed body parts. If you are sensitive to these issues, we recommend that you do not use the Website. AvatarStudio.art.com is not responsible for any discomfort or offense that may be caused by the results generated by the model.

Usage of User Data

As a user of our website and apps, you acknowledge and agree that your data may be used on any of our platforms, including marketing pages, to display current user activity. This helps us to improve the user experience and understand how our products and services are being used. By using our website and apps, you consent to the collection and use of your data for these purposes.

Deleting User Data

If you would like to request the deletion of your data, including any uploaded photos, generated photos, and AI models, please send a request to delete@avatarstudio.art. Please note that it may take up to 30 days for your data to be fully deleted from our systems.

Please also note that we may retain certain information as required by law or for legitimate business purposes. For example, we may retain certain information for recordkeeping purposes or to prevent fraud.

These Terms of Use and your use of the Website will be governed by and construed in accordance with the laws of Israel, without giving effect to any principles of conflicts of law.

Refund

Unfortunately, we are unable to offer refunds for our services. Once the photos are uploaded and payment is made, we immediately begin training the AI model, which incurs a high cost for us. We apologize for any inconvenience this may cause. Thank you for your understanding.

Availability

AvatarStudio.art does not guarantee constant availability of Website access and accept no liability for down time or access failure due to circumstances beyond its reasonable control (including any failure by ISP or system provider).

Security

As a user of our website, you agree to keep all security features confidential, including login methods and access arrangements. You are responsible for maintaining the confidentiality of these features and agree not to disclose them to any unauthorized parties. Avatar AI will not be held liable for any breaches of security that may occur as a result of your failure to maintain the confidentiality of these features. Please take care to protect the security of our website and its access methods at all times.

It is not possible to guarantee the complete security of data transmitted over the internet. While we make efforts to protect your information, we cannot fully guarantee its security when transmitted to us. By sending us your information, you acknowledge and accept the risk involved. We apologize for any potential inconvenience this may cause.

Affiliate Program

Advertising Rules

Affiliates are prohibited from using AvatarStudio keywords, such as "avatarstudio.art," in their advertising campaigns. Any affiliate found to be violating this rule will have their account terminated.

Earnings

Affiliates will earn 50% of the profit per user referred to AvatarStudio. Please note that profit may change from time to time due to changes in prices or the offering of coupons. Profits can only be withdrawn after 60 days from the moment of purchase, provided no refund or chargeback was made. Any chargebacks will be deducted from the affiliate's payment.

Withdrawals

Withdrawals: Withdrawals are currently only possible for Israeli-based companies via wire transfer and globally via PayPal (fees apply). The minimum withdrawal amount is $100.00. An invoice is required for us to send the money.

Termination

AvatarStudio reserves the right to terminate an affiliate's account at any time if the affiliate violates our terms of use or any other applicable laws or at our sole discretion.

Indemnification Agreement

As a user of our website, you agree to defend and hold harmless AvatarStudio.art and its employees and agents from any losses or liabilities that may arise from any unauthorized or improper access to our website or any breach of these terms by you or your employees, contractors, or representatives. We appreciate your cooperation in helping to protect our company and its agents from any potential harm.

Changes to the Terms of Use

AvatarStudio.art reserves the right to change these Terms of Use at any time. Any changes will be effective immediately upon posting on the Website. By continuing to use the Website after any changes are posted, you are indicating your acceptance of those changes.
